Due to COVID, the food industry has been affected to a great extent and many restaurants went out of business during this time. Dine-in options were canceled in many of the existing restaurants and food delivery platforms have been playing a major role in keeping their business afloat.

On that note, to increase business Food aggregators like Zomato and Swiggy have extended their business to small towns and are witnessing considerable growth in their revenue in the past few months. The delivery companies are also increasing their partnership with cloud kitchens to keep up with the changing scenario.

Due to the work from the home condition, most of the city dwellers have moved to their hometowns during this pandemic and it has been found that one in every five users opens their app from small towns. One-third of the relocated individuals have started ordering from their new locations.

The report also found that the delivery time is found to be three minutes earlier in small towns when compared to buzzing cities due to less traffic in smaller towns. At first, people were very much concerned about safety and sanitation but due to the company’s contactless delivery and strict safety measures, the orders started to pick up.

In this pandemic, around 10% of the restaurants have been shut permanently and only 17% are allowing dine-in options. So, this partnership of cloud Kitchen ventures with food aggregators has increased its profits in recent times.

TATA group’s entry into the tech sector has been marked with the launch of an integrated ‘Super App’ that will combine the company’s consumer offerings on a single platform.  The new app will help TATA compete with business rivals like Reliance and Amazon among others. TATA Digital will function in e-commerce platforms like Tata CLiQ for online grocery store StarQuik and Croma for the online electronic platform.

As per the reports, the app is all set to be launched by December this year. The move came after Reliance Jio had raised $20 Bn from its 15 investors. Reliance digital services through its Jio plans has increased its range of offerings in eCommerce, online grocery, healthcare, and video conferencing, among others. Recently Reliance acquired an online pharmacy NetMeds in order to boost its presence in the field of e-pharmacy. Amazon, on the same line, has tried to increase its online grocery service. In its recent move, it entered the pharmacy and online food delivery segment.

Chairman of Tata Sons Natarajan Chandrasekaran, said that the new ‘Super App’ would help consumers to avail of a range of services, that includes the food and grocery ordering, fashion and lifestyle, consumer electronics and consumer durables, insurance, and financial services, education, healthcare, and bill payments.

The concept of ‘Super App’, first originated in China, when there was a ban from the government on western apps such as Google, YouTube, and Twitter, among others, which triggered the rise of the homegrown app.

Initially, it was seen as a puppet app under the Chinese Government, but the success of WeChat has made the people sit back and ponder. It was launched in 2011 by Tencent which was a Chinese internet giant as a messaging platform, but with the success of the app, it brought in it other features like order takeout, online flight booking, digital payments, movie bookings, and ride-hailing services, among others. WeChat with time became one of the world’s largest standalone mobile applications with 800 Mn monthly active users,

The hike is one such example which says why the super app might be a failure in India. Indian market which is used to western apps puts a lot of competition to homegrown apps in India and this opens up a lot many ways for customers to choose apps from various segments like cab-hailing, hotel and flight booking, movie tickets, food delivery, and eCommerce among others. The huge amount of choices available to the customers in India makes customer loyalty for one single app a big dream and people tend to move from one app to the other. So it ends up like there is only one Super app in India which stands to be the smartphone that has a loyal customer base and it goes up to 500 Mn. It also has a large number of Internet users which makes the country the first option for tech companies to establish their markets.

A new advertising code will be released soon by the ministry of consumer affairs mentioning the do’s and don’ts in advertising. This will eventually help to identify the misleading advertisements circulating around various platforms. Advertisers from now onwards cannot make big claims such as ‘largest-selling’, ‘most popular’, and ‘most effective’, particularly in the case of Health products.

As per the source, the ministry is trying to implement the best advertisement code taken from other countries like New Zealand, the United Kingdom, and the United States.

“A draft discussion paper will be uploaded on our website for stakeholder consultation. There is a need to have a code for the benefit of consumers and also to help identify quickly which fall under the misleading category, otherwise, there will be a sea of complaints about misleading advertisements,” said an official.

Advertising Standards Council of India is a self-regulatory voluntary organization in the advertising industry that has framed a code for self-regulation in Advertising which is rigid in itself. The need for a new code was felt after the center had informed the central consumer protection authority about misleading advertisements. “There is a need to bring the proposed under the regulation for their effective compliance. Simple guidelines won’t have the desired impact,” a source said.

In the case of Celebrity endorsers, the Act specifies that the company must be clear with its contents and claims to the endorsers.
Countries that follow a strong consumer protection rule specifies that the codes are framed in order to make sure that every advertisement displayed must be legal and truthful on its claims.

Havmor has filed a suit against a Delhi-based pickle and cereals brand in relation to trademark violation. As per the accusation, Hands On Trade and VLS Foods Pvt ltd have brought their products in the market under the brand name of ‘Usha Aunty’s Havemore’. The popular Ahmedabad based brand Havmor has requested the court to stop the company from using the word “Havemore” as its trademark or any other word which is similar to that of the ice cream brand. Havmor has also dragged Grofers India an online retailer into the controversy for selling the products.

It has now asked compensation of Rs 2.8 lakh as a part of the damage. VLS Foods who manufactures products for Hands On Trade has marketed under the alleged trademark. Havmor further claimed that Hands On Trade have used a similar trademark to sell cereals, chocolate flakes, corn flakes, pickles, and ketchup. The ice cream brand further said that they came to know about this illegal adoption of the trademark from the month of May when the company employees came across these products being displayed in Grofers for sale. In addition to it, Havmor has also claimed that Hands On Trade had applied for trademark registration on the 10th of January for which even the trademark has mentioned it as ‘finding the trademark identical and similar’.

Havmor, on May 29, sent a notice to all the three companies, in reply to which, Hands On Trade had said that the full name of the trademark displayed is ‘Usha Aunty’s Havemore’ and this is what makes it different from another trademark. However, Havmor protested saying that the company had applied for the registration of the name Havmor which is quite misleading in itself.

Jaideep Verma who is the lawyer for  Hands On Trade had refused to comment on the matter which is still in sub judice and the case is running at Ahmedabad civil court, the next hearing for the same will take place next on September 4.
