Havmor Accuses Delhi-based Brand Of Trademark Theft
Havmor has filed a suit against a Delhi-based pickle and cereals brand in relation to trademark violation. As per the accusation, Hands On Trade and VLS Foods Pvt ltd have brought their products in the market under the brand name of ‘Usha Aunty’s Havemore’. The popular Ahmedabad based brand Havmor has requested the court to stop the company from using the word “Havemore” as its trademark or any other word which is similar to that of the ice cream brand. Havmor has also dragged Grofers India an online retailer into the controversy for selling the products.
It has now asked compensation of Rs 2.8 lakh as a part of the damage. VLS Foods who manufactures products for Hands On Trade has marketed under the alleged trademark. Havmor further claimed that Hands On Trade have used a similar trademark to sell cereals, chocolate flakes, corn flakes, pickles, and ketchup. The ice cream brand further said that they came to know about this illegal adoption of the trademark from the month of May when the company employees came across these products being displayed in Grofers for sale. In addition to it, Havmor has also claimed that Hands On Trade had applied for trademark registration on the 10th of January for which even the trademark has mentioned it as ‘finding the trademark identical and similar’.
Havmor, on May 29, sent a notice to all the three companies, in reply to which, Hands On Trade had said that the full name of the trademark displayed is ‘Usha Aunty’s Havemore’ and this is what makes it different from another trademark. However, Havmor protested saying that the company had applied for the registration of the name Havmor which is quite misleading in itself.
Jaideep Verma who is the lawyer for Hands On Trade had refused to comment on the matter which is still in sub judice and the case is running at Ahmedabad civil court, the next hearing for the same will take place next on September 4.
